Ben Hutman is a partner in Sadis’ Litigation group. Ben concentrates his practice on complex commercial and appellate litigation matters.  Ben represents both plaintiffs and defendants on diverse matters, including business divorce, securities litigation, commercial contract disputes, unfair competition, privacy litigation, and shareholder derivative suits, among other commercial matters.

Ben has successfully fought for his clients on matters in New York State trial and appellate Courts, the Southern District of New York, the Second Circuit Court of Appeals, and FINRA Arbitrations, and AAA Arbitrations.  In addition, together with local counsel, Ben has successfully represented clients in various other state and federal courts.  Ben’s clients have ranged from large banks and multinational corporations to individual investors and shareholders.  
 
Ben began his career at Boies, Schiller & Flexner, LLP working in the complex litigation group, after graduating magna cum laude from Georgetown University Law Center.

  • Achieved a multi-million dollar settlement in a Delaware derivative action, SDF Funding LLC v. Fry, No. 2017-0732-KSJM (Del. Ch. 2024).
  • Won summary judgment for $7.8 million in the New York Supreme Court in Star Strong Master, LLC v. 10th Mountain Funds LLC, et al, No. 651425/2023 (N.Y. Sup. 2023).
  • Part of appellate team that won twice before the Second Circuit—successfully vacating the District Court decision—in Fasano v. Li, 47 F.4th 91 (2d Cir. 2022) and Fasano v. Yu Yu, 921 F.3d 333 (2d Cir. 2019).
  • Part of the trial team winning a nearly $1.9 million FINRA arbitration award for a hedge fund against Interactive Brokers arising from the broker’s inability to trade WTI Oil Futures at negative prices. FPP CIS Opportunities Fund, L.P. v. Interactive Brokers, LLC, No. 20-02623 (Sept. 16, 2021).
  • $14.5 million recovery for a minority member in a cannabis company. Weisz v. Palliatech Florida LLC, et al., AAA Case No. 01-0004-5355.
  • Part of appellate team that won appeal before the Second Circuit—clarifying a critical area of law for investors and leading to a substantial settlement—in FIH, LLC v. Foundation Capital Partners, LLC, 920 F.3d 134 (2d Cir. 2019).
  • Successfully defended appeal before the First Department Appellate Division in the matter of Meer Enterprises, LLC v. Kocak, 173 A.D.3d 629 (1st Dep’t 2019)
  • Part of the trial team that won a significant award on behalf of traders and against Interactive Brokers in a FINRA arbitration for breaches of fiduciary duty, negligence, and negligent misrepresentation.   • Part of the trial team that won a complete defense at trial for the officers of Group IX, Inc. in a shareholder derivative action. Moyal v. Sleppin, et al, 2018 N.Y. Slip. Op. , No. 601973/2007 (N.Y. Sup. Dec. 12, 2018).
  • Obtained summary judgment on behalf of the Plaintiff on breach of fiduciary duty and fraudulent conveyance claims for co-founder of Bareburger restaurant chain resulting in large confidential settlement. Stavroulakis v. Pelakanos, 2018 N.Y. Slip. Op. 50180(U) (N.Y. Sup. February 13, 2018).
